The rules West Virginia medical cannabis patients live by

Getting the card is half of it. The other half is knowing what you can buy, how you can use it, and where it cannot go.

How much you can buy

A West Virginia medical cannabis patient may buy up to 6 ounces of flower or 60 grams of concentrate in a rolling 30-day period, unless the registered physician specifies otherwise. That is OMC's own summary of the limit.

"Rolling" matters. The limit does not reset on the first of the month. OMC says the amount you buy is restored 30 days after the purchase date. If you buy on the 10th, that amount comes back on the 9th or 10th of the next month, depending on the month's length.

OMC converts between forms using 1 gram of processed THC as equal to 2.835 grams of flower. The law also says a dispensary may not sell you more than a 30-day supply until you have used all but a seven-day supply.

If you live far from a dispensary, this is worth planning around. Keep a note of your purchase dates so you know what is available before you make the drive.

Forms you can use

OMC lists these forms as allowed:

  • Pills
  • Oils
  • Topical forms, including gels, creams and ointments
  • Tinctures
  • Liquids
  • Dermal patches
  • A form medically appropriate for vaporization or nebulization, including dry leaf or plant form

No smoking, no combustion

Smoking medical cannabis is unlawful in West Virginia, and OMC says that includes any combustion. Rolling papers, pipes and similar combustion accessories are prohibited. Vaporizing flower is allowed. A 2026 bill to allow smoking, HB 5188, died in committee. Our guide to the smoking rule explains where the line falls.

No edibles from the dispensary

Dispensaries may not sell edibles. The law does let a patient or caregiver mix medical cannabis into food at home to aid ingestion. A 2026 bill to allow some dispensary edibles passed the House and stalled in the Senate. Details are in our edibles guide.

No growing at home

Growing medical cannabis is unlawful unless you hold a grower/processor permit from the state. Patients cannot grow plants at home. A 2026 home cultivation bill, HB 5259, would have allowed 10 plants. It died in the House Health and Human Resources committee.

Carrying it with you

Keep any medical cannabis you are not using in its original dispensary package. Carry your OMC card whenever you have medical cannabis on you. If a dispensary label is the only thing tying the product to you, do not throw it away.

Stay inside the state line

OMC says licensed patients and caregivers may not travel outside West Virginia with medical cannabis. Its checklist adds that the card is valid only in West Virginia and offers no legal protection for products obtained outside the state's medical cannabis system.

This catches people in border towns. If you live along the Ohio River or in either panhandle, a quick errand across the bridge with cannabis in the car is a trip outside the state. Leave it at home.

Driving

OMC's FAQ says medical cannabis patients are not exempt from state or federal impaired-driving laws. The Medical Cannabis Act as passed in 2017 goes further: it bars a patient from operating or being in physical control of a vehicle, aircraft, train, boat or heavy machinery with more than 3 nanograms of active THC per milliliter of blood in serum. We could not read the current code directly, so check whether that figure has changed.

The practical rule is simple. If you have used medical cannabis, do not drive. Long rural drives make this hard, so plan rides on days you need to medicate.

Online evaluations are available for West Virginia residents. Before you pay, ask how the physicians handle the in-person part of continuing care that the state law mentions. Code DRWDY85872 takes 5% off.

Places the law does not cover

The Act as passed in 2017 says it does not protect possession or use in state correctional facilities, regional jails or youth detention facilities. It also does not protect doing a task under the influence when that would be negligence or malpractice. If you work in a safety-sensitive job, read about your card and your job.

Where to go from here

If you are still deciding whether the program is worth it, our page on whether weed is legal in West Virginia explains why the card is the only legal route. If you already have your card, the dispensary guide covers what to expect on your first visit, and the caregiver page covers who can buy for a patient who cannot get there.
