Recreational use is not legal
Adult-use, or recreational, cannabis is not legal in West Virginia as of October 2026. The Office of Medical Cannabis says it plainly in its FAQ: "Adult/Recreational cannabis use is not legal in the State of West Virginia." There are no adult-use stores, and having a friend with a medical card does not change that for you.
Medical cannabis is legal, with a card
Medical cannabis has been legal since Senate Bill 386, the Medical Cannabis Act, which Gov. Jim Justice signed on April 19, 2017. The law lives in Chapter 16A of the West Virginia Code. The Office of Medical Cannabis, within the Bureau for Public Health at the West Virginia Department of Health, runs the program.
Legal here means legal for a registered patient or caregiver, buying from a licensed dispensary, in an allowed form, within the limits. You need:
- West Virginia residency
- One of the 15 qualifying conditions in the law
- A certification from an MD or DO registered with OMC
- An approved OMC card
Our application guide covers each step, and the qualifying conditions page lists all 15.
What stays off limits even with a card
A card does not make everything legal. Smoking and any other combustion are banned. Dispensaries may not sell edibles. Growing at home is unlawful without a state permit. And you cannot take medical cannabis outside West Virginia. The full set of patient rules has the details.
How the law has changed
The 2017 Act set up the program. In 2019, Senate Bill 1037 reworked parts of it. It moved the 10% tax from growers and processors to dispensaries, and its text says a physician can certify a patient only after the state has approved that physician for its registry. In 2025, OMC's legislative rules (64 CSR 109 through 113) were revised, and OMC says the revisions are now active.
The statute excludes dry leaf, or flower, until the state allows it by rule. OMC now lists dry leaf for vaporization as an approved form.
The 2026 session: lots of bills, no new law
Several bills to change the medical program were introduced in the 2026 regular session. None became law.
| Bill | What it would have done | What happened |
|---|---|---|
| HB 5260 | Allow dispensary edibles (lozenges and gelatins, max 10 mg THC per serving) | Passed the House 66-26 on March 4, 2026; referred to Senate Health and Human Resources March 5; did not become law |
| HB 5188 | Allow smoking | Died in House committee |
| HB 5259 | Allow home cultivation of 10 plants | Died in House Health and Human Resources committee |
| HB 5092 | Let physicians certify for conditions at their discretion | Died in House committee |
| HB 5615 | General telehealth changes (does not mention cannabis) | Died in House committee |
| HB 5074 | Change how the Medical Cannabis Program Fund is allocated | Passed both chambers March 14, 2026; vetoed by the Governor April 1, 2026 |
This table covers the bills we tracked for this guide. It is not a list of every cannabis bill filed in 2026.

Online evaluations are available for West Virginia residents. Before you pay, ask how the physicians handle the in-person part of continuing care that the state law mentions. Code DRWDY85872 takes 5% off.

OMC's checklist says the West Virginia card is valid only in West Virginia. We found no OMC information saying dispensaries here accept cards from other states, and dispensing requires a valid West Virginia OMC card. The 2017 Act let the state make reciprocity agreements so terminally ill West Virginia cancer patients could buy in another state, but we found no such agreement in place.
What this means for you
If you live in West Virginia and have a qualifying condition, the card is the only legal way to buy cannabis here. If you do not qualify, there is no legal retail option in the state right now. If you do, the next step is a registered physician. Our page on online evaluations in WV explains your options, and the edibles guide covers the dispensary ban and the bill that stalled.
