Edibles and West Virginia's medical cannabis program
You cannot buy edibles at a West Virginia dispensary. The law does let you, or your caregiver, make them at home. A bill to put some edibles on dispensary shelves got halfway through the Legislature in 2026 and then stopped.
The dispensary ban
West Virginia's Medical Cannabis Act makes it unlawful to incorporate medical cannabis into edible form or to sell it in edible form. That is why you will not find gummies, chocolates or baked goods at a licensed dispensary here. OMC's list of allowed forms reflects that: pills, oils, topicals, tinctures, liquids, dermal patches, and forms for vaporization or nebulization.
The home exception
The same section of the law carves out an exception. A patient or caregiver may incorporate medical cannabis into edible form "to aid ingestion." OMC's patient page says the same thing in its own words: patients and caregivers may make their own edibles.
A few practical points if you go that route:
- Start with a product bought legally from a West Virginia dispensary. The card gives no protection for products from outside the state's medical cannabis system.
- Write down which product and how much you used, so you know what is in each batch.
- Label homemade edibles clearly and store them where children and pets cannot get to them. A cookie looks like a cookie.
- Edibles can take longer to feel and can last longer than other forms. Ask your certifying physician how to approach dosing before you make your first batch.
Keep any unused dispensary product in its original package, as the law requires.
HB 5260: the bill that stalled
In the 2026 regular session, HB 5260 would have allowed dispensaries to sell some edibles: lozenges and gelatins, with a maximum of 10 mg of THC per serving. It passed the House 66-26 on March 4, 2026. On March 5 it was referred to the Senate Health and Human Resources committee, and that was its last action. It did not become law.
So as of October 2026, the dispensary ban stands. If the Legislature takes the idea up again, we will update this page.
Rather not drive to an appointment?
Online evaluations are available for West Virginia residents. Before you pay, ask how the physicians handle the in-person part of continuing care that the state law mentions. Code DRWDY85872 takes 5% off.
Book my evaluation →Alternatives to homemade
If the point of an edible for you is avoiding inhaling anything, several allowed forms do that without any kitchen work. Pills, tinctures, oils and liquids are swallowed or taken by mouth. Dermal patches and topicals go on the skin. Your physician can help you sort out which fits.
Smoking, for the record, is banned too. Our smoking rule guide explains where vaporizing fits.
Safety
Do not drive after eating a homemade edible. OMC says patients are not exempt from impaired-driving laws, and because edibles can take a while to kick in, it is easy to misjudge when you are fine. And remember the travel rule: medical cannabis, homemade or not, may not leave West Virginia.
Where to go from here
The patient rules cover purchase limits, storage and travel. Our page on whether weed is legal in West Virginia lists the other 2026 bills that did not pass. And when you are ready to buy, the dispensary guide explains how to use the official list.
