Can you smoke medical cannabis in West Virginia?

No. Smoking medical cannabis is unlawful in West Virginia, even with a valid card. You can buy flower, and you can vaporize it. You cannot burn it.

What the ban covers

The Office of Medical Cannabis says it is unlawful to smoke medical cannabis, and that this includes any combustion. It also says rolling papers, pipes and similar combustion accessories are prohibited.

So the test is not the device's name. It is whether the cannabis is set on fire. A joint, a pipe, a bong and a blunt all involve combustion, and all are off limits for patients.

What is allowed instead

OMC lists "a form medically appropriate for administration by vaporization or nebulization," including dry leaf or plant form. Vaporizing heats cannabis without burning it. Nebulizing turns a liquid into a fine mist. Both are allowed.

The rest of the allowed list is pills, oils, topicals such as gels, creams and ointments, tinctures, liquids and dermal patches.

Flower was not always on the list

The statute leaves dry leaf out until the state allows it by rule. OMC now lists it as an approved form for vaporization. That is why you can find flower at West Virginia dispensaries today even though smoking remains banned.

It also explains the slightly odd situation patients sometimes notice: the product looks like what people smoke, but the law only lets you vaporize it.

The 2026 bill that would have changed it

In the 2026 regular session, HB 5188 would have allowed smoking. It was introduced in February 2026 and died in House committee. The ban is still the law as of October 2026. Our page on whether weed is legal in West Virginia lists the other 2026 bills.

Practical points

  • Ask your dispensary which vaporization products they carry before you drive over. OMC says hours and product availability come from the dispensary.
  • Keep unused flower in its original dispensary package.
  • Carry your card whenever you have medical cannabis with you.
  • Do not take it out of West Virginia. OMC says patients may not travel outside the state with medical cannabis.
  • Do not drive after using it. Patients are not exempt from impaired-driving laws.

If you have never vaporized

If you are used to the idea of smoking and have never used a vaporizer, talk with your certifying physician about whether vaporizing suits you at all. Pills, tinctures and patches avoid inhaling anything. Dispensary staff can explain how a device works, but questions about your health belong with the physician.

Edibles are the other rule people ask about. Dispensaries cannot sell them, but you can make your own; see the edibles guide. For purchase limits, storage and travel, the patient rules page has everything in one place, and the dispensary guide covers your first visit.
