Anxiety and the West Virginia medical cannabis list

The short answer is no

Anxiety is not a qualifying condition for a West Virginia medical cannabis card. It does not appear on the state's list of 15 serious medical conditions, and a physician cannot certify you for a condition that is not on the list. We would rather tell you that now than have you pay for an appointment that cannot end the way you hoped.

What the list covers

West Virginia's Medical Cannabis Act names these conditions: cancer; positive status for HIV or AIDS; amyotrophic lateral sclerosis; Parkinson's disease; multiple sclerosis; damage to the nervous tissue of the spinal cord with objective neurological indication of intractable spasticity; epilepsy; neuropathies; Huntington's disease; Crohn's disease; post-traumatic stress disorder; intractable seizures; sickle cell anemia; severe chronic or intractable pain, including pain of neuropathic origin; and terminal illness.

The only mental health condition on that list is post-traumatic stress disorder. The qualifying conditions page explains each entry in plain English.

PTSD is a different diagnosis

PTSD and anxiety can share symptoms, but they are separate diagnoses. For the program, PTSD must be diagnosed as part of continuing care by a medical doctor, a licensed counselor or a psychologist. Our PTSD article covers how that works.

Please do not treat PTSD as a way around the list. If you have lived through trauma and think PTSD may describe what you are going through, the right step is an honest evaluation with a clinician. If they diagnose PTSD, you can take that to a registered physician. If they diagnose something else, that is the answer.

When anxiety comes with a listed condition

Some people with a listed condition also deal with anxiety. Someone with cancer, MS or chronic pain might be anxious about their health, their work or their sleep. In that case, certification rests on the listed condition. Anxiety may come up in your conversation with the physician, but it is not the reason you qualify.

Online evaluations are available for West Virginia residents. Before you pay, ask how the physicians handle the in-person part of continuing care that the state law mentions. Code DRWDY85872 takes 5% off.

How the list could change

There are two routes.

The Legislature can change the law. In 2026, HB 5092 would have let physicians certify patients for conditions at their own discretion. It was introduced in February 2026 and died in a House committee. No conditions have been added to the list since at least 2019.

The Office of Medical Cannabis also accepts an application to add a medical condition. Anyone can read it. Filing one does not guarantee anything, but it is the official way to ask.

Other things to know

Adult-use cannabis is not legal in West Virginia, so there is no store to buy from without a card. Our page on whether weed is legal in West Virginia covers the full picture. A card from another state will not help either; we found no OMC information saying West Virginia dispensaries accept them, and patients must be state residents.

Cannabis can also cause or worsen anxiety in some people. That is worth keeping in mind whatever the law says.

What you can do now

Talk with your doctor or a counselor about treatment options for anxiety that are available to you today. If you have another condition that is on the list, read about it on the qualifying conditions page and bring your records to a registered physician. And if you think anxiety belongs on the list, the OMC petition form is the place to make that case.

Questions people ask

Can a doctor certify me for anxiety anyway?

No. A certification must be for one of the 15 serious medical conditions in West Virginia law. A 2026 bill, HB 5092, would have let physicians certify for other conditions at their discretion, but it died in committee.

Is generalized anxiety disorder covered under PTSD?

No. They are different diagnoses. PTSD is on the list and must be diagnosed as part of continuing care by a medical doctor, licensed counselor or psychologist. Generalized anxiety disorder is not on the list.

Can I use a card from another state in West Virginia?

We found no OMC information saying out-of-state cards are accepted. Dispensing requires a valid West Virginia OMC card, and patients must be West Virginia residents.
