Medical cannabis and multiple sclerosis in West Virginia

Multiple sclerosis is named outright on West Virginia's list of qualifying conditions. If you have the diagnosis, qualifying is usually the simple part. Managing appointments, paperwork and dispensary trips while living with fatigue or mobility problems is harder, and that is what most of this article is about.

On the list by name

The Medical Cannabis Act lists "multiple sclerosis" as a serious medical condition. A registered physician must certify you, and your MS must be diagnosed as part of your continuing care. Bring records from the neurologist who diagnosed you, along with your current medicines.

A second entry that may also fit

The law separately lists "damage to the nervous tissue of the spinal cord with objective neurological indication of intractable spasticity." In plain terms, that is spinal cord damage where an exam or test shows stiffness or spasms that have not let up with treatment. Some people with MS fit both entries. You only need one, and the physician decides which applies.

When getting there is the hard part

Three parts of the program can lighten the load.

First, caregivers. You can name up to two, and dispensaries sell to registered caregivers as well as patients. A spouse, adult child or close friend can apply. See the caregiver guide for the notarized form and background check.

Second, online visits. OMC lists telemedicine companies and says visits can be online; the law itself still refers to in-person consultation as part of continuing care, so ask the provider how they handle it. Read about online evaluations in WV before you book.

Third, the rolling 30-day limit. You can buy up to 6 ounces of flower or 60 grams of concentrate in a rolling 30-day period, unless your physician sets a different amount. Knowing your purchase dates lets you plan fewer, better-timed trips.

Rather not drive to an appointment?

Online evaluations are available for West Virginia residents. Before you pay, ask how the physicians handle the in-person part of continuing care that the state law mentions. Code DRWDY85872 takes 5% off.

Forms you can use

West Virginia allows pills, oils, tinctures, liquids, topicals such as gels, creams and ointments, dermal patches, and forms for vaporization or nebulization, including flower. Smoking is banned. Dispensaries do not sell edibles.

If hand weakness or tremor makes droppers or small devices hard to use, mention it. Pills or patches may be easier to handle, and your physician can help you weigh the options.

What research says about MS

MS-related spasticity and pain have drawn a fair amount of research. Some studies suggest certain cannabis products may ease spasticity or pain for some people with MS, while effects are often modest and vary from person to person. It is not a treatment for the disease itself. Keep taking the treatments your neurologist prescribes unless they tell you otherwise.

Balance, falls and other medicines

Cannabis can cause dizziness and drowsiness. If MS already affects your balance, that matters. Start any new product at home, when you do not have to go anywhere, and take care on stairs. Tell your neurologist about it, since you may already take medicines for spasticity, bladder symptoms or sleep that can also cause drowsiness.

Do not drive after using medical cannabis. OMC says patients are not exempt from impaired-driving laws.

Renewal comes around fast

Your card lasts one year, and each renewal needs a new physician certification. You can file no earlier than 60 days before your card expires. In a hard year, book the renewal visit early so you are not doing paperwork during a flare.

Where to begin

Request your neurologist's records, decide whether you want a caregiver, and then choose a registered physician. When you have your certification, the application guide walks you through the portal, and the qualifying conditions list shows both entries in full.

Questions people ask

Do I need a neurologist's letter?

The law requires your condition to be diagnosed as part of your continuing care. A letter or records from the neurologist who diagnosed your MS is the simplest way to show that to the certifying physician.

Can someone else help if I cannot drive to a dispensary?

You can name up to two caregivers. Each needs proof of West Virginia residency, a notarized designation form signed by you, a fingerprint background check and a $50 fee that can be waived for hardship.
